AMailMe Terms and Conditions
Welcome to AMailMe, an email and communications service provided by AyeSearch ("AyeSearch," "AMailMe," "we," "us," or "our"). These Terms govern your access to and use of AMailMe websites, applications, email accounts, messaging features, storage features, APIs, and related services. By creating an AMailMe account, accessing the Service, or using the Service, you agree to these Terms.
1. The AMailMe Service
AMailMe provides tools to send, receive, organize, store, and manage electronic communications and related content. Features may be added, modified, replaced, limited, or discontinued over time.
2. Your Account
You are responsible for maintaining the security of your account, credentials, devices, and recovery information. You must not sell, transfer, rent, or provide unauthorized access to your account.
3. Your Email Address
Usernames and email addresses are subject to availability. Registration of an address does not grant ownership of AMailMe, AyeSearch, their domains, trademarks, or infrastructure.
4. Acceptable Use
You may use AMailMe for lawful personal, professional, and business communications. You must not use AMailMe to send unlawful spam, conduct phishing or fraud, distribute malware, harass others, infringe legal rights, bypass security controls, gain unauthorized access, or otherwise violate applicable law.
5. Your Content
You retain ownership of content that belongs to you, including emails, attachments, files, and profile information. You grant AyeSearch the limited rights reasonably necessary to host, store, transmit, process, secure, back up, and otherwise handle that content to provide and protect AMailMe and comply with applicable law.
6. Email Delivery
Sending an email does not guarantee delivery. Delivery can be affected by recipient mail-server policies, spam filters, incorrect addresses, attachment restrictions, network failures, storage limits, reputation, and third-party providers.
7. Spam and Abuse Prevention
AMailMe may apply sending limits, receiving limits, rate limits, automated abuse detection, reputation systems, quarantines, and other protections. Accounts engaged in significant abuse may be restricted or suspended.
8. Storage
Accounts may have storage, message-size, attachment, bandwidth, and other resource limits. Functionality may be restricted while an account exceeds its available storage.
9. Security
We use technical and organizational safeguards intended to protect the Service and its users, but no internet-based service can be guaranteed to be completely secure or continuously available.
10. Privacy
Privacy practices for AMailMe are described only in the AMailMe Privacy Policy.
11. Intellectual Property
AyeSearch and its licensors retain their rights in AMailMe software, interfaces, designs, trademarks, logos, branding, and other proprietary materials.
12. Third-Party Services
AMailMe may rely on third-party services and infrastructure to support certain features. Availability and performance of those external services may affect corresponding AMailMe features.
13. Paid Services
Certain features may require payment. Applicable price, billing period, taxes, renewal terms, cancellation rules, and other conditions will be disclosed at purchase.
14. Suspension and Termination
We may restrict, suspend, or terminate access when reasonably necessary to address serious or repeated Terms violations, fraud, spam, security threats, illegal activity, nonpayment, binding legal requirements, or material risks to users or infrastructure.
15. Account Closure
You may stop using AMailMe and close your account through available account-management options, subject to applicable retention requirements.
16. Inactive Accounts
We may establish an inactive-account policy. Any specific inactivity period used for deletion will be disclosed in the applicable AMailMe policy before inactivity-based deletion is enforced.
17. Service Availability
We aim to keep AMailMe available and reliable but do not guarantee uninterrupted or error-free operation.
18. Changes to AMailMe
We may update the Service as it evolves. Where required by law, material changes affecting users' rights will receive appropriate notice.
19. Changes to These Terms
We may update these Terms to reflect changes in the Service, technology, business, legal requirements, security practices, or operational needs.
20. Disclaimers
To the extent permitted by law, AMailMe is provided on an "as is" and "as available" basis. Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.
21. Limitation of Liability
To the maximum extent permitted by applicable law, AyeSearch will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use AMailMe, except where liability cannot legally be limited or excluded.
22. Indemnification
To the extent permitted by law, business or organizational users agree to indemnify and hold harmless AyeSearch and its affiliates from third-party claims resulting from unlawful use of AMailMe or material violation of these Terms.
23. Governing Law and Disputes
These Terms are governed by the laws applicable to the legal entity operating AyeSearch, subject to mandatory consumer protections and applicable jurisdictional requirements.
24. Severability
If a provision is invalid or unenforceable, the remaining provisions continue to apply to the fullest extent permitted by law.
25. No Waiver
Failure to immediately enforce a provision does not waive the right to enforce it later.
26. Entire Agreement
These Terms and any additional terms presented for specific AMailMe features govern your use of AMailMe. Privacy practices are described separately in the AMailMe Privacy Policy.
